Tom Principe is a Partner at Kramer, Dillof, Livingston & Moore (KDLM) in New York. Tom Principe’s background is as a defense attorney. In that capacity he squared off more than once against fellow partner Tom Moore – who recruited him to become a KDLM partner in April 1989. Gaier argued Applewhite v. Accuhealth, Inc. in the Court of Appeals (New York State’s highest court), which held that the plaintiffs were entitled to establish at trial that the New York City Fire Department EMTs owed a special duty to a 12-year-old girl who was having an anaphylactic reaction and in respiratory distress. Tom Moore tried the case and a jury found that a special duty was owed, that the City was negligent, and that the plaintiffs were entitled to $172 million in damages.

Carmine A. Rubino is a member of both the New York and Connecticut bars. He also is a member of the New York State Trial Lawyers Association, and the Brooklyn, Bronx, Queens and Richmond Bar associations.

He graduated with a B.A. from Lemoyne College, Syracuse, N.Y., and received a J.D. degree from Loyola University in New Orleans.

Mr. Oginski was one of the first lawyers in the Country to create educational video to help injured consumers understand how cases like these work. Mary is an associate attorney at Kramer, Dillof, Livingston & Moore. She is committed to client-centered advocacy and building trust with her clients, colleagues, and opposing counsel through her work ethic and candor. As an associate at KDLM, Mary works on medical malpractice cases throughout the process of litigation.

Prior to joining KDLM, Mary practiced as a public defender for over nine years in New York and New Hampshire, representing both juvenile and adult clients from inception of a case to disposition. Mary litigated numerous bench and jury trials and hearings and obtained favorable outcomes for hundreds of clients at all stages of the criminal and family legal process. At Brooklyn Defender Services, Mary was a member of the Medically Complicated unit, where she was successful in defending clients accused of allegations of AHT/SBS, Munchausen by Proxy, and other medical allegations, and gained valuable experience in cross-examining expert doctors and working with medical records in hearings and trials. She is proud to continue her mission-driven work of seeking justice for her clients, often in difficult and life-changing situations, at KDLM.

Mary Gibbons graduated from Fordham University in the Bronx, summa cum laude, and from Fordham University School of Law, magna cum laude and Order of the Coif. While at Fordham Law, she was a Stein Scholar in Public Interest and Ethics, a member of the Urban Law Journal, and an editor of the Brendan Moore Trial Advocacy Program. Outside of work, Mary is involved in her Brooklyn community through her neighborhood run club and volunteering with her law school trial advocacy team. She enjoys attempting to learn new languages, catching free concerts in the city, and hiking and camping with her husband, daughter, and their rescue dog, Sweetie Pie.
