Thomas A. Moore

KDLM Senior Partner

Tom Moore is one of the very best trial lawyers in the United States. Many attorneys and clients believe he is the best: he was named the National Law Journal’s “Lawyer of the Year” not just once, but twice. And he has been named to the “Top Ten” list of attorneys in New York multiple times in the last dozen years. In 2014, American Legal Media announced its Medical Malpractice Hall of Fame. Tom had four of the top 25 cases; more than any other attorney. And two of those cases were the second and third largest verdicts in New York history.

Tom Principe is a Partner at Kramer, Dillof, Livingston & Moore (KDLM) in New York. Tom Principe’s background is as a defense attorney. In that capacity he squared off more than once against fellow partner Tom Moore – who recruited him to become a KDLM partner in April 1989. Today, his experience and perspective serve KDLM’s clients well as he conducts examinations before trial. Those depositions and discovery illuminate the defense’s claims and likely strategy. He is painstakingly thorough in his approach, sifting through and examining medical records and transcriptions for information to aid in client defense.

Gaier argued Applewhite v. Accuhealth, Inc. in the Court of Appeals (New York State’s highest court), which held that the plaintiffs were entitled to establish at trial that the New York City Fire Department EMTs owed a special duty to a 12-year-old girl who was having an anaphylactic reaction and in respiratory distress. Tom Moore tried the case and a jury found that a special duty was owed, that the City was negligent, and that the plaintiffs were entitled to $172 million in damages.
